China Court Declares Crypto as Legal Property


China's courts have ruled that cryptocurrencies are lawful property, despite Beijing's 2021 nationwide ban on them. Additionally, the courts have ruled that these assets are protected by property rights and regulations.

China Court Calls Digital Assets Protected as Legal Property

China's digital asset market has had a very bumpy road. Beijing has adopted a restriction on digital assets, but other regions have worked to advance the sector nationwide. As a result, many people have tried to expand their digital infrastructure by using Web3 technology.


A recent revelation from the China Court claims that cryptocurrency is already lawful property despite that very ban in 2021. The research also states that property law provides enough protection for these assets. In fact, the report titled Identification of the Property Attributes of Virtual Currency and Disposal of Property Involved in the Case makes note of the revelation.


The report talks specifically about these digital assets' economic merits. The ODaily News therefore quoted the report's authors as saying that these virtual currencies are "still legal property and is protected by law." Additionally, the research contends that notwithstanding the prohibition, any held digital assets ought to be regarded as lawful and protected by property law. 


The committee also recommended that crimes involving this currency be handled differently. specifically because it is impossible to seize the money or property in question. It was observed that various cases should be treated differently in order to balance the interests of the general public and private property rights.
